Sheena Jacob
Sheena is Head of the Intellectual Property & Technology practice group of ATMD in Singapore. She has been practising law since 1989 and is a founding member of the firm.

Experience
Sheena has a wide range of experience in intellectual property for a large number of clients. Her areas of practice range from advice on patent and trade mark protection, enforcement of intellectual property rights, data protection, privacy issues, advising on regulation of internet and media content, copyright infringements, software licensing and development, technology transfer and other technology contracts, conducting antipiracy campaigns against counterfeiters, advising technology and biotechnology companies, developing licensing strategies for intellectual property protection and advising on intellectual property portfolio management, government lobbying efforts and policy initiatives for clients to enhance protection of their intellectual property rights, advice on anti-competition issues in licensing.

  • Advising Microsoft, Pfizer, Starhub on various intellectual property issues
  • Acting as Counsel for the Business Software Alliance whose members include Autodesk, Adobe, Apple, Microsoft and Symantec in Singapore in advising on its anti-piracy policy and education initiatives in Singapore
  • Advising biotech companies including ProTherapeutics, Spinevision, Coopervision, Singvax, Attogenix
  • Government lobbying and policy initiatives on behalf of clients
  • Advising clients on the Free-Trade Agreement (FTA) between the United States and Singapore, including meeting with US Government officials from the US Trade Representative’s Office and the Copyright Office; advising clients on the implementation of the FTA
  • Advising on patent applications for the protection of inventions on behalf of local and foreign clients, such as Seiko Epson Corporation, Samsung, Creative Technology, Kimberly-Clark, Exploit Technologies, ST Electronics (Satcom & Sensor Systems), NXP Semiconductor
  • Advising on trade mark protection and brand strategies
  • Advising companies on patent filing strategies, patent infringement and freedom to operate strategies, patent audits and due diligence and drafting contracts for the exploitation of patented technologies
  • Drafting and reviewing various internet agreements, software licence and development agreements
  • Drafting and reviewing technology contracts involving intellectual property including research and development agreements, collaboration agreements, non-disclosure agreements
  • Led IP team acting for lead Swiss investor in relation to investment in Singapore biotech company, Merlion; led IP team acting for petroleum multinational in co-branding arrangement
  • Advising on operation of internet sites and portals for Microsoft, Yahoo! in Singapore and advising companies on internet content, linking, framing and copyright issues
  • Advising on privacy, data protection, spam control, protection of trade secrets, know-how and confidential information for clients.
  • Advising and coordinating large-scale investigations into anti-piracy activities; coordinating simultaneous enforcement actions at different locations; and coordinating the largest enforcement action against an optical disk manufacturer in Singapore.
  • Conducting criminal enforcement actions for breach of intellectual property rights including conducting raids and prosecuting offenders under authorisation from the Attorney General’s Chambers.
  • Enforcement of all forms of intellectual property rights including applications for Anton Piller Orders, ex-parte injunctions, and applications for contempt of court for breach of injunctions
  • Drafting and reviewing media and entertainment contracts for Singapore listed media company; sponsorship and advertising contracts; advising on use of content in different media.

Professional background
Sheena obtained a Bachelor of Laws Second Class (Upper) in 1988 from the National University of Singapore and a Masters in Law (Trade Regulation) in Intellectual Property and Anti-trust from New York University School of Law in 1990.

She was admitted as an Advocate and Solicitor of the Supreme Court of Singapore in 1989 and as an attorney in the State of New York, USA in 1992. She is a registered Singapore patent agent.

Sheena is a member of the American Bar Association, the Association for the Protection of Industrial Property and the Pharmaceutical Trade Mark Group. She is the Chair of the ICT committee of the American Chamber of Commerce and a member of the Singapore Treaty Promotion Subcommittee of the Treaty Analysis Committee (TAC) of INTA.

She has also written numerous articles and conducted many seminars on intellectual property and technology and has appeared on Asia Business News and Channel NewsAsia programs on intellectual property protection. She is a thought leader on intellectual property issues in South-east Asia.

She has been named one of AsiaLaw’s Leading Lawyers in 2004 to 2008 in the area of Intellectual Property and a Leading practitioner in the Guide to the World’s Leading Trade Mark Practitioners (2004, 2006 editions) and World’s Leading Patent Law Experts (2005, 2007 editions). She is also listed as a Specialist Individual in the category of Trade marks/copyright (contentious) and Patents (contentious) in World IP Survey 2006 and a leading practitioner in both Patents and Trade Marks in Who’s Who Legal Singapore 2008.
